Planning without real intent isn’t really against the law, and this sounds like another case where undercover informants talked them into it and helped provide plans\materials, etc

They didn’t interact with him until the arrest.
I think the suggestion is that this someone else was a FBI plant.
Which would be a crazy leap from the available information.
